Fixed Fee Services for Employees

Our Employment Law services are conducted by an experienced and qualified Solicitor and any work carried out by a caseworker is overseen by a solicitor.

Faizal is a Fellow of the Chartered Institute of Legal Executives and is also admitted as a Legal Executive Advocate. Faizal is an experienced Litigation Lawyer. Our solicitor, Gina Samuel-Richards, supervises all employment work.

All fees attract VAT of 20%

Stage 1

Initial consultation – to understand the situation and advise possible steps

£250 plus VAT (£50)

  • 1 Hour Consultation
  • Reviewing of documents provided by you
  • Advising on next steps and costs

Stage 2

Dealing with the ACAS Early Conciliation Period

£206.50 plus VAT

A. Drafting a letter of grievance for the client to provide to the employer or,
B. Letter compliant with provisions of ACAS Code of Practice on Disciplinary and Grievance Procedures.

Extra £50 plus VAT payable if the letter is to be sent by our firm

Or

Letter of Appeal – appeal against dismissal or disciplinary action taken against an employee

£206.50 plus VAT

A. Drafting a letter of appeal for the client to provide to the employer or,
B. Letter compliant with provisions of ACAS Code of Practice on Disciplinary and Grievance Procedures.

Extra £50 plus VAT payable if the letter is to be sent by our firm

Stage 3

Settlement Agreement advice

£442.50 plus VAT (usually paid by the employer)

• Reviewing client’s Employment Contract and proposed Settlement Agreement
• Providing oral advice over the telephone
• A Solicitor signing the required Certificate

Stage 4

Contract of Employment Advice

£305 plus VAT (extra £100.00 plus VAT payable for each restrictive covenant)

• Considering client’s proposed or existing employment contract.
• Providing the client with written advice on terms, including enforceability of restrictive covenant(s).

Unfair and/or Wrongful Dismissal/Constructive Unfair Dismissal claims – Claimant

Disbursements
Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Counsel’s fees estimated between £1,000 to 25,000 +VAT per day (depending on experience of the advocate) for attending a Tribunal Hearing (including preparation)

Our overall fee to conduct your dismissal claim could cost between £3,975 +VAT to £7,000 depending on how the Respondent conduct their litigation.

Timescales
Employment cases generally take 1 year to run.

Staged 1-4 can typically take 1-2 weeks each. Stages 6-9 and 11 can typically take 2-3 weeks each.  Where a stage involves a date for a hearing, we are reliant on the Tribunal to set the date, so we are unable to give an estimate as to timescales.

Damage based Fees
You will be asked to pay for your disbursements, including advocacy fees in advance.

Disclaimer
Our fixed fees do not include:
(a) settlement discussions or negotiations (save for those related to ‘stage 2’)
(b) *instructing a barrister or a suitably qualified advocate, fees will be discussed with you as necessary
(c) attending a Preliminary Hearing (save for those related to ‘stage 5’)
(d) appealing a decision made by the Employment Tribunal or enforcing any order made by the employment tribunal
(e) preparation of the bundle of the documents (normally prepared by the respondent)

Any time spent dealing with aspects outside of the fixed fee arrangement will be charged at £305.00 per hour plus VAT

The fee set out for attending the Tribunal is based on a hearing (both final hearing and preliminary/case management hearings) taking place at the Leicester Employment Tribunal. There may be an additional charge if the hearing takes place elsewhere, depending on the location. Such charge may include:

  • Travel expenses being the price of return 2nd class ticket and taxi charges to the Tribunal venue from our offices in Leicester or £0.45 per mile and parking charges
  • Accommodation and subsistence expenses being £200 plus VAT per hearing day
  • Overnight charge being £175 plus VAT per night
  • Waiting charge being £29.50 plus VAT per hour
